End User Licence Agreement

Terms for the DarkMatter apps.

This End User Licence Agreement ("EULA") governs your use of the DarkMatter VPN software applications ("Apps") provided by Darkmatter VPN LTD, a company registered in England and Wales (company number 13230150) whose registered office is at 86-90 Paul Street, London, EC2A 4NE ("DarkMatter", "we", "us"). By installing or using an App, you agree to this EULA. It works alongside our Terms of Service; where the App is concerned, this EULA adds to those Terms.

1. Licence grant

We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to install and use the Apps on devices you own or control, solely to access the DarkMatter service in line with your subscription and its device limit. This is a licence, not a sale; we and our licensors retain all rights in the Apps.

2. What you may not do

You may not, except to the extent the law expressly allows:

  • copy, modify, or create derivative works of the Apps;
  • reverse-engineer, decompile, or disassemble the Apps, or attempt to extract their source code;
  • rent, lease, lend, sell, sublicense, or otherwise redistribute the Apps;
  • remove or alter any proprietary notices; or
  • use the Apps to breach our Acceptable Use Policy or any applicable law.

3. Updates

We may provide updates, which may include security fixes, new features, or changes to existing ones. Where an App updates automatically, this EULA applies to the updated version. Keeping the Apps up to date helps keep you secure.

4. Third-party components

The Apps may include third-party or open-source components licensed under their own terms. Those terms govern your use of the relevant components, and in the event of a conflict for that component, the third-party licence prevails. We make the applicable notices available on request.

5. App-store terms

If you obtained an App through a third-party app store, your use is also subject to that store's rules. Where a store requires it, the store's own terms may take precedence for that distribution, and purchases made through a store are governed by that store's refund policy rather than our Refund Policy.

6. Ownership

The Apps and all intellectual property in them belong to Darkmatter VPN LTD or our licensors. Nothing in this EULA transfers ownership to you.

7. Termination

This licence ends automatically if you breach this EULA, and it ends when your subscription or account ends. On termination you must stop using the Apps and remove them from your devices.

8. Disclaimer and liability

The Apps are provided "as is" without warranties of any kind, to the fullest extent permitted by law. Our liability in connection with the Apps is subject to the same limitations set out in our Terms of Service, and nothing here removes any rights that cannot be excluded by law.
