These Terms of Service ("Terms") are an agreement between you and Darkmatter VPN LTD, a company registered in England and Wales (company number 13230150) whose registered office is at 86-90 Paul Street, London, EC2A 4NE ("DarkMatter", "we", "us"), governing your use of the DarkMatter VPN service, apps, and website (together, the "Service"). By creating an account or using the Service, you agree to these Terms. If you do not agree, please do not use the Service.
1. Eligibility
You must be at least 18 years old, or the age of majority where you live, and able to enter into a binding contract to use the Service. By using DarkMatter you confirm that you meet these requirements.
2. Your account
You are responsible for keeping your account credentials secure and for activity that happens under your account. Enable two-factor authentication where available for added protection, and tell us promptly at support@darkmattervpn.com if you believe your account has been compromised.
3. Acceptable use
Your use of the Service must comply with our Acceptable Use Policy. DarkMatter is a tool for privacy and security, not a shield for illegal activity. We may suspend or terminate accounts that breach that policy.
4. Subscriptions, billing, and renewals
- Plans and pricing. The plans and prices shown at checkout apply to your purchase. Before you pay, we show you the total you pay today and the price each renewal will charge. Prices may change, but a change will not affect the term you have already paid for.
- First-term prices. Some plans may have a lower price for your first term (a "first-term price"). First-term prices are for new customers only: people who have never bought a DarkMatter plan before, at any price and on any account (including through an app store), and have never had a money-back refund from us. To check this we use your account history, your email address and the payment method you pay with. If you do not qualify, your first term is charged at the plan's renewal price, and you will see that price before you pay.
- Renewal. At the end of each billing term, your subscription renews automatically for another term of the same length, at the renewal price shown to you when you bought (or when you last changed your plan), unless you cancel beforehand. If we ever need to change the renewal price of your plan, we will tell you in advance and you can cancel before the change applies.
- Changing your plan. If you change your plan in your account, the change takes effect at your next renewal: nothing is charged or refunded when you make it, and you keep your current plan until then. From that renewal the new plan renews at its standard price (first-term prices do not apply to plan changes). Before the change is booked, we show you the new plan's renewal price and the date it starts, and ask you to confirm. Until then you can undo the change in your account; we show you the last day you can.
- Cancellation. You can cancel at any time from your account. Cancellation stops future renewals, and your plan keeps working until the end of the term you have paid for. It does not refund the current term, with one exception: if a renewal charge wasn't wanted, cancel within 14 days of it and we'll refund the unused part (cancelling in your account within those 14 days counts as asking), and your plan then stops. See our Refund Policy. This doesn’t affect your legal right to cancel a new order within 14 days, explained in Your right to cancel.
- Payment. Payments are processed by our third-party payment providers. Card details are handled directly by those providers and are not stored on DarkMatter's servers.
5. Money-back guarantee
Your first purchase is covered by a money-back guarantee: 30 days on a plan of 3 months or longer, and 14 days on a monthly plan, as set out in our Refund Policy. One money-back refund is available per customer.
6. The Service
We work hard to keep DarkMatter fast and reliable, but we provide the Service on an "as available" basis and do not guarantee uninterrupted or error-free operation. Server availability, protocols, and features may change as we improve the Service. A VPN is one layer of privacy and security; it is not a substitute for safe online habits, antivirus software, or lawful conduct.
7. Third-party services and content
The Service may let you reach third-party websites and services, which have their own terms and licensing rules. We are not responsible for third-party content, and you agree to comply with the terms of the services you access.
8. Intellectual property
The DarkMatter apps, website, branding, and content are owned by Darkmatter VPN LTD or our licensors and are protected by law. We grant you a limited, non-exclusive, non-transferable licence to use the apps for your personal use of the Service, as described in our EULA. You may not copy, resell, or reverse-engineer the Service except as the law expressly permits.
9. Suspension and termination
We may suspend or terminate your access if you breach these Terms, the Acceptable Use Policy, or applicable law, or to protect the Service and its users. You may stop using the Service and close your account at any time.
10. Disclaimers and liability
To the fullest extent permitted by law, the Service is provided without warranties of any kind, and our liability to you is limited to the amount you paid for the Service in the 12 months before the event giving rise to the claim. Nothing in these Terms limits any liability that cannot be limited by law, including your statutory consumer rights.
11. Changes to these Terms
We may update these Terms from time to time. When we make material changes we will update the date above and, where appropriate, notify you. Continuing to use the Service after changes take effect means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of England and Wales, and are subject to any mandatory consumer-protection rights available to you where you live.
